This is an interesting topic, the ongoing saga of Mr. Gambert trademarking the term SEO continues.

 
I've attached an article I came across whilst on Sphinn (http://sphinn.com/story/42401 - I include this so you can view the comments left by readers) from ArteWorks SEO It makes interesting reading.

 
On the other side of the coin Mr. Gambert has released a statement via his website (the address for the website was found on Sphinn): http://www.jasongambert.com/ regarding his attempt at trademarking SEO.
